At Arvesta, we are committed to the privacy and protection of the personal data of everyone from whom we collect personal data. We therefore take all appropriate measures to protect your privacy in accordance with applicable laws and regulations, including Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the ‘GDPR’). 

The purpose of this privacy notice is to inform you about how we handle the personal data we collect from you, why we collect it, how we intend to use it and how we process it. 

When does this privacy statement apply? 

This privacy statement applies to all personal data that ARVESTA collects and processes from users of this website and from job applicants. 

Who is the data controller? 

The various companies that employ staff within the ARVESTA group of companies are joint data controllers (hereinafter referred to as ‘ARVESTA’ or ‘we’). A full list of the joint data controllers can be found at the end of this privacy statement. 

As joint data controllers, the companies have agreed that ARVESTA BV, with company number 0737.818.127, with its registered office at 3012 Leuven (Wilsele), Aarschotsesteenweg 84, shall be responsible for the practical fulfilment of the obligations regarding the provision of information and the exercise of your rights in relation to the processing of personal data. 

A Data Protection Officer has been appointed within ARVESTA to oversee the protection of your personal data. You can contact this person via dpoarvesta@contrast.law. 

What personal data do we collect and process about you via this website? 

When you apply for a job – whether on your own initiative or in response to a specific vacancy – ARVESTA collects and processes your data: 

• Which you provided yourself via the ARVESTA job site; 
• Which ARVESTA obtained through your application via social media (including Facebook, LinkedIn, Messenger and Instagram); 
• Which ARVESTA received through personal contacts, telephone calls and/or emails with or from you; 
• Which ARVESTA received from external selection and recruitment agencies with which ARVESTA collaborates in connection with your application. 

This may include, amongst other things, the following data: 

• Your CV, your photograph if you choose to provide one, and your cover letter; 
• Identification details such as surname and first name(s); 
• Personal details such as date of birth, place of birth, gender and nationality; 
• (Where applicable) Possession of a work and/or residence permit for the European Economic Area (EEA); 
• Contact details such as place of residence, address, email address, telephone number (landline and/or mobile); 
• Educational details such as qualifications, work placements, specialised training, further training and courses; 
• Skills such as driving licence, language skills, IT skills, interpersonal skills and professional experience with previous employer(s); 
• Hobbies and memberships. 

The list above is not exhaustive; other data necessary to assess suitability for a specific vacancy may also be processed. 

ARVESTA does not collect or process sensitive information about applicants, such as data relating to race, political opinions, religious or philosophical beliefs, trade union membership, health, sexual life, suspicions, prosecutions or criminal or administrative convictions. If, in a specific situation, sensitive information about an applicant were nevertheless to be collected, this would be done on the basis of a valid ground for exception, e.g. the data is disclosed by the applicant themselves, or information required for the assessment of fitness for work in accordance with applicable law. 

Purpose and legal basis for processing and storing your personal data 

Your personal data is processed in order to register your application – whether unsolicited or in response to a specific vacancy. The processing of the above data is carried out on the basis of ARVESTA’s legitimate interest, in particular the screening, selection and recruitment of suitable and competent employees for a specific role. This data is subsequently also used to inform you of the action ARVESTA is taking in response to your application. 

In addition, we also use your data to carry out studies and compile statistics, ensuring that any link to an individual is removed as quickly as possible. Aggregating data for the development of analytical models enables us to gain data-driven insights, which are used to support strategic decisions regarding the quality of our selection and recruitment process. 

Finally, if you are shortlisted, your data will be used to draw up an employment contract, as well as to send you a login via email so that you can log in to the applicant portal on the website. This profile allows you, amongst other things, to review your application, keep track of your scheduled interviews and provide us with additional information, if necessary. We will also request additional necessary information, including your e-ID details, a copy of your highest qualification and your bank account number. 

The data collected and processed by ARVESTA from applicants is appropriate, relevant and not excessive for the specific purposes for which it is collected and processed. 

Accuracy of data – As an applicant, you are aware that the data you provide must be up to date, accurate and complete to ensure a proper selection and recruitment process. By submitting your application, you expressly declare that all data you provide is accurate and reliable. 

Contacting previous employers or professional contacts – ARVESTA requests your consent to contact your previous employers and/or the contact persons you have provided. ARVESTA reserves the right to supplement the application information obtained. 

Retention period for your data 

ARVESTA uses your personal data only where there is a clear purpose for doing so. As soon as that purpose ceases to apply, we will delete your data. 

Your personal data will be retained for a period of one (1) year, regardless of whether your application is successful or not. Subject to the candidate’s consent, the personal data may be included in the recruitment pool. In this case, ARVESTA will retain your personal data for three (3) years. 

Disclosure of personal data 

In order to ensure the high-quality and efficient processing of personal data, ARVESTA may enter into agreements with third parties – including hosting providers – to carry out the processing on our behalf and exclusively in accordance with our instructions. Service providers to whom your personal data is transferred are bound by specific agreements and are obliged to keep your personal data secure. It is important to emphasise that your personal data will under no circumstances be sold to third parties. 

Disputes and other incidents may also result in your personal data being shared – in exceptional circumstances – with the police and other judicial authorities. 

For the purposes of internal reporting within ARVESTA, with a view to establishing consistent HR-related policies across the group, your personal data may be shared with companies within the ARVESTA group. 

The technical processing and transfer of personal data (whether within ARVESTA or to third parties) may involve the transfer of personal data via various networks, including the transfer of your personal data to other countries. This may also involve a transfer to countries outside the European Economic Area that do not guarantee an adequate level of protection. In such cases, ARVESTA will take adequate security measures (for example, through standard contractual clauses for the transfer of personal data) to ensure that your personal data is adequately protected. 

Security of your personal data 

ARVESTA has put in place appropriate measures to protect your data against, amongst other things, unauthorised access, unlawful use, accidental or deliberate alterations, loss, destruction or damage. These measures take into account the technical capabilities, the nature, scope and context of the data, the purpose of the processing, and the risk associated with the processing. 

In order to protect the confidentiality of personal data and to prevent this data from falling into the hands of, or being processed or altered by, unauthorised persons, ARVESTA has implemented the necessary internal measures. 

Access to applicants’ personal data is restricted to those persons for whom such access is relevant to the performance of their duties. Furthermore, persons who may consult this data are bound by professional secrecy. 

Furthermore, ARVESTA also takes the necessary technical measures to prevent your personal data from falling into the hands of and being processed by unauthorised persons. In the event of any data exchange, ARVESTA ensures that data is only exchanged if the recipient guarantees that equivalent measures have been taken. 

Your rights as a job applicant 

You have the right, at any time and free of charge, to request access to the personal data processed about you or to request the rectification of inaccurate or incomplete personal data in the context of the recruitment process. You also have the right to request the erasure of the data being processed. The applicant is free to withdraw the consent given for processing at any time if they so wish. The applicant also has the right to object to the way in which ARVESTA processes certain data on the basis of its legitimate interests, or to request that processing be restricted in specific circumstances. 

Although you have the right to request that your personal data be erased, we may be required to retain certain personal data due to a legal obligation to keep specific records. 

How can you exercise your rights? 

To exercise these rights, please send a request by email or post to ARVESTA BV, via privacy@arvesta.eu, or to: ARVESTA BV – HR, Aarschotsesteenweg 80, 3012 Wilsele (Leuven). 

To exercise your rights and to prevent any unauthorised disclosure of your personal data, please include the following information with your request: full name, address, email address, and a clear description of your request. Additional information may be requested in order to better define the subject of your enquiry, if necessary, or to verify your identity in the event of reasonable doubt. 

We have one month to respond to your request, unless an extension of that period is necessary. Please note that this period begins when we have received your dated and signed request in writing by post, electronically, or in person, and we have all the information required to comply with your request. 

If you believe that we have not handled your request correctly or if you have a complaint about how ARVESTA handles your personal data, please contact us using the details above. If this does not produce the desired result, you have the right to lodge a complaint with a supervisory authority in the country where you usually reside. For Belgium, this is the Belgian Data Protection Authority. 

Changes to this policy 

If we make any changes to this privacy statement, the amended statement will be published here with the revision date stated at the top.
